 Drug Convictions Minimize

DRUG RELATED CONVICTIONS

 

Title IV eligibility is suspended for a student convicted of violating any Federal or State drug possession or sale law.

 

For a drug possession conviction, eligibility will be suspended for:

 

1.       One year for the first offense

2.       Two years for the second offense, and

3.       Indefinitely for the third offense

 

For a drug sale conviction, eligibility will be suspended for:

 

1.       Two years for the first offense, and

2.       Indefinitely for the second offense

 

A person’s Title IV eligibility may be resumed before the end of the ineligible period if:

 

1.       The student satisfactorily completes a drug rehabilitation program and complies with criteria established by the Department of Education and such progress includes two unannounced drug test; or

2.       The conviction is reversed, set aside, or otherwise rendered nugatory.
